Our Services include automated tenant communication through AI agents that draft email responses, lead tracking and analytics systems, automatic tour scheduling capabilities, integration with property management systems such as AppFolio and Buildium, and various other automation tools designed to streamline rental property operations. We continuously update and improve our Services, and the features available may change over time.
To access our Services, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security. We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion, particularly if we believe there has been a violation of these Terms or applicable law.
You agree to use our Services only for lawful purposes and in accordance with these Terms. While our AI technology is sophisticated, it is not infallible and should be used as a tool to assist, not replace, human judgment and oversight. You acknowledge that AI-generated content, including email responses and communications, should be reviewed for accuracy and appropriateness before being sent to tenants or other parties. We do not guarantee the accuracy, completeness, or reliability of AI-generated content, and you remain responsible for all communications sent through our platform.
Payment terms for our Services will be specified in your service agreement or subscription plan. All fees are non-refundable unless otherwise specified in writing. We reserve the right to change our pricing at any time, with notice provided to existing customers before such changes take effect. If payment is not received by the due date, we may suspend or terminate your access to the Services. You are responsible for all taxes associated with your use of our Services, except for taxes based on our net income.
The Quirkey.ai platform, including all software, algorithms, designs, text, graphics, and other content, is owned by us and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use our Services in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code of our platform, unless laws prohibit those restrictions or you have our written permission.

These integrations are provided for your convenience, but we do not control these third-party services and are not responsible for their availability, functionality, or content. Our total liability to you for all claims arising from or relating to these Terms or our Services shall not exceed the amount paid by you to us in the twelve months preceding the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Quirkey.ai and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of our Services, your violation of these Terms, your violation of any third-party rights, or any data or content you provide to our Services. This indemnification obligation will survive termination of these Terms and your use of our Services.
Either party may terminate these Terms at any time with or without cause. Upon termination, your right to use our Services will cease immediately, and we may delete your account and data in accordance with our data retention policies. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability. We reserve the right to terminate or suspend your account immediately if we believe you have violated these Terms or applicable law.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Quirkey.ai is incorporated, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property infringement or other urgent matters. You waive any right to a jury trial or to participate in a class action lawsuit.
